1. Acceptance of Terms

By accessing or using the voicemail.ie service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and voicemail.ie.

2. Description of Service

voicemail.ie provides a cloud-based voicemail service that assigns users dedicated Irish +353 phone numbers. The Service includes voicemail reception, AI-powered transcription, message analysis (summaries, urgency detection, sentiment analysis), notifications, and a web-based dashboard for managing messages.

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and that the information you provide is accurate and complete.

4. Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and account.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

5. Free and Premium Plans

The Service is available under Free and Premium plans. Details of current plan features and pricing are available on our website. We reserve the right to modify plan features and pricing with 30 days' notice. Changes to pricing will not affect the current billing period.

6. Payment and Billing

For Premium Plan subscribers:

  • Subscription fees are billed monthly in advance.
  • Payment is processed securely by our third-party payment provider.
  • You authorise us to charge your provided payment method on a recurring basis.
  • Failed payments may result in suspension of Premium features until payment is resolved.
  • You may cancel your Premium subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are provided on a case-by-case basis at our discretion.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Engage in spam, fraud, or any form of unsolicited communication.
  • Transmit any material that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
  • Impersonate any person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorised access to any part of the Service.
  • Use the Service for any commercial purpose not expressly permitted by these Terms.
  • Use the assigned phone number for purposes other than voicemail reception.

8. Phone Numbers

Phone numbers assigned to your account remain the property of voicemail.ie and our telephony providers. You are granted a licence to use the assigned number(s) for the duration of your active account. We reserve the right to reassign numbers from inactive accounts (no activity for 90+ days on Free accounts). Number porting away from our Service is not currently supported.

9. AI-Generated Content

The Service uses artificial intelligence to generate transcriptions, summaries, urgency ratings, and sentiment analysis. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You acknowledge that AI outputs are provided as aids and should not be relied upon as the sole source of information for critical decisions. We accept no liability for actions taken based on AI-generated content.

10. Intellectual Property

The Service, including its design, features, and content (excluding user-generated voicemail content), is owned by voicemail.ie and protected by intellectual property laws. You retain ownership of your voicemail recordings. By using the Service, you grant us a limited licence to process your voicemail content solely for the purpose of providing the Service.

11. Service Availability

We aim to provide the Service with 99.9% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.

12. Limitation of Liability

To the maximum extent permitted by law, voicemail.ie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be error-free, or be available at all times.

14. Indemnification

You agree to indemnify and hold harmless voicemail.ie and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

15. Termination

You may terminate your account at any time through the dashboard settings or by contacting us. We may terminate or suspend your account if:

  • You breach these Terms.
  • Your account has been inactive for more than 90 days (Free accounts).
  • We are required to do so by law.
  • We discontinue the Service (with reasonable notice).

Upon termination, your data will be handled in accordance with our Privacy Policy.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
